Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the LifeCapsule mobile application ("App") or any related services ("Services") operated by LifeCapsule Pte. Ltd. ("LifeCapsule", "we", "our", or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Services.

These Terms constitute a legally binding agreement between you and LifeCapsule Pte. Ltd., a company incorporated in Singapore. By accepting these Terms, you confirm that you are at least 17 years of age and have the legal capacity to enter into this agreement.

2. Description of Service

LifeCapsule is a legacy planning and digital estate management application that allows you to:

• Securely store personal, financial, legal, and identity information in an encrypted digital vault
• Create messages (text, audio, video) and letters to be delivered to designated contacts
• Designate emergency contacts who will receive your stored information upon an inactivity trigger
• Manage your post-life legacy preferences including funeral arrangements, last wishes, and executor details

We reserve the right to modify, suspend, or discontinue the Services or any part of them at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuance.

3. Account Registration

To use the Services, you must create an account by providing accurate and complete information. You are responsible for:

• Maintaining the confidentiality of your account credentials (password, PIN, biometric settings)
• All activity that occurs under your account
• Notifying us immediately of any unauthorised use of your account at support@life-capsule.link
• Ensuring the accuracy and currency of all information you provide

You may not create more than one account per person or use another person's account without their explicit permission. We reserve the right to suspend or terminate accounts that violate these Terms.

You may register using an email address and password, or through Apple Sign In or Google Sign In. When using third-party login providers, their respective terms of service and privacy policies also apply to your use of those services.

4. Subscriptions & Payment

LifeCapsule offers both a free tier and optional paid subscription plans ("Premium", "Family"). Paid subscriptions are billed through Apple's App Store or Google Play on a recurring basis.

• Billing: Subscription fees are charged to your App Store or Google Play account at the start of each billing period
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
• Cancellation: You may cancel your subscription at any time through your device's App Store or Google Play subscription settings. Cancellation takes effect at the end of the current billing period — no refunds are issued for unused portions of a subscription period
• Price changes: We may change subscription prices upon reasonable notice. Continued use after a price change constitutes acceptance of the new price
• Refunds: All refund requests are handled by Apple or Google in accordance with their respective policies. We do not process refunds directly

Features available on the free tier may change over time. We reserve the right to move features between tiers with reasonable notice.

5. Acceptable Use

You agree to use LifeCapsule only for lawful purposes and in a manner consistent with all applicable laws and regulations. You must not:

• Use the Services to store, transmit, or distribute any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Attempt to gain unauthorised access to any part of the Services, other users' accounts, or our infrastructure
• Use the Services to impersonate any person or entity, or falsely represent your affiliation with any person or entity
• Upload or transmit viruses, malware, or any other malicious code
• Reverse-engineer, decompile, or disassemble any part of the App
• Use automated scripts, bots, or crawlers to access the Services
• Attempt to circumvent any security or access control measures
• Use the Services in any way that could damage, disable, or impair our servers or networks

We reserve the right to investigate and take appropriate action against any user who violates these provisions, including suspension or termination of accounts and referral to law enforcement authorities.

6. Intellectual Property

All intellectual property rights in the App, Services, software, design, trademarks, and content created by LifeCapsule (excluding your personal data and content you upload) are owned by LifeCapsule Pte. Ltd. or our licensors. Nothing in these Terms grants you any right to use our trademarks, logos, or brand features.

You retain ownership of all content and personal data you upload to the App ("Your Content"). By using the Services, you grant LifeCapsule a limited, non-exclusive, worldwide licence to store, process, and transmit Your Content solely for the purpose of providing the Services to you — including delivering your capsule to your designated contacts when the trigger conditions you set are met.

You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe any third-party intellectual property rights.

7. Data & Privacy

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You acknowledge that the sensitive nature of the information you store in LifeCapsule (financial details, identity documents, personal messages) means that you bear responsibility for keeping your account credentials secure. We implement industry-standard security measures, but we cannot guarantee absolute security.

You are solely responsible for the accuracy of the information you store and for ensuring that your emergency contacts are willing and able to receive and act upon your capsule.

8. Disclaimers

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, error-free, or free of viruses or other harmful components
• The results obtained from using the Services will be accurate or reliable
• The quality of any information or content obtained through the Services will meet your expectations
• Capsule delivery will occur within any specific timeframe

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIFECAPSULE PTE. LTD. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:

• Your use of or inability to use the Services
• Any unauthorised access to or alteration of your data
• Failure of capsule delivery due to incorrect contact details, changed email addresses, or other circumstances outside our control
• Any content obtained from the Services
• Any other matter relating to the Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR SGD 100 IF YOU HAVE NOT MADE ANY PAYMENTS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

10. Termination

You may terminate your account at any time by using the "Delete Account" feature in the App or by contacting us at support@life-capsule.link. Upon account deletion, your personal data and Vault contents will be permanently deleted within 30 days in accordance with our Privacy Policy.

We may suspend or terminate your account immediately, without prior notice or liability, if:

• You breach any provision of these Terms
• We are required to do so by law
• We decide to discontinue the Services (with reasonable notice where possible)

Upon termination, your right to use the Services ceases immediately. Sections 6, 8, 9, and 11 of these Terms survive termination.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of Singapore, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Singapore.

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.

12. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will:

• Update the "Last updated" date at the top of this page
• Send you an in-app notification and/or email notification
• Where required by law, ask for your renewed consent

Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the revised Terms, you must stop using the Services.
